By installing or using this Shopify app ("the App"), you agree to these Terms of Service.
1. App Functionality
The App provides functionality for displaying a VAT relief declaration within a Shopify store's shopping cart.
The App is intended solely as a tool to assist merchants in presenting VAT relief information to customers.
The App does not independently determine customer eligibility for VAT relief, verify declarations, calculate or remove VAT, or guarantee compliance with any applicable tax legislation.
2. Merchant Responsibility
The merchant is solely responsible for ensuring compliance with all applicable VAT laws, regulations, and record-keeping requirements, including those established by HM Revenue & Customs (HMRC), where applicable.
This includes responsibility for:
Ensuring the VAT relief declaration is legally appropriate and correctly displayed.
Obtaining any legally required customer declarations, eligibility details, and supporting documentation.
Verifying customer eligibility for VAT relief.
Correctly applying VAT exemptions or relief.
Maintaining and retaining all legally required records.
Ensuring the store's checkout, payment, and tax configuration complies with applicable laws.
The App does not guarantee that displaying a VAT relief declaration satisfies any legal requirement for obtaining, recording, or retaining evidence of VAT relief eligibility.
3. Disclaimer and Limitation of Liability
The App is provided on an "as is" and "as available" basis, without warranties of any kind, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, the App developer shall not be liable for any losses, damages, penalties, fines, tax liabilities, or other costs arising from:
Failure to collect, store, or retain legally required VAT relief information.
Missing, inaccurate, incomplete, or invalid customer declarations.
Incorrect VAT exemptions, calculations, or tax treatment.
Failure to comply with HMRC requirements or other applicable legislation.
Reliance on the App as a complete VAT compliance solution.
Errors, interruptions, or limitations in the display or operation of the App.
Nothing in these Terms excludes or restricts liability that cannot legally be excluded or restricted.
4. Indemnification
To the fullest extent permitted by applicable law, the merchant agrees to indemnify and hold harmless the App developer from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from the merchant's failure to comply with applicable VAT legislation, misuse of the App, or failure to obtain, verify, or retain legally required VAT relief information.
This indemnity does not apply to the extent that a claim or loss results from the App developer's negligence, breach of these Terms, or other liability that cannot lawfully be excluded.
5. Privacy and Data
The App does not independently collect or store customer information outside Shopify.
Merchants remain responsible for collecting and retaining any information required for VAT relief compliance.

6. Changes to the App
We reserve the right to modify, update, suspend, or discontinue the App or its functionality at any time.
7. Changes to These Terms
We may update these Terms of Service periodically. Continued use of the App following publication of revised Terms constitutes acceptance of those changes, to the extent permitted by applicable law.
